Certificate of Free Sale
You will need a Certificate of Free Sale Apostilled if you will be exporting products from the United States of America to a foreign country that is a member of the Hague Convention. Foreign customers or foreign governments are often required to supply a certification relating to the products or goods legally sold or distributed in the open market, without restrictions, and approved by the administrative authorities in the country of orgin. The Certificate of Free Sale is issued by either:
- The local Chamber of Commerce or
- The Department of Health amd Human Services, Food and Drug Administration (FDA) division. This document certifies that the products listed are on file with the FDA as regulated by the Federal Food, Drug, and Cosmetic Act (FD&C Act).
We recommend that you inquire with the ones who are requesting the certificate to clarify who should issue the Certificate of Free Sale.
Only foods that meet the specifications of section 801(e) of the FD&C Act [21 U.S.C. 381(e)] may be exported from the United States of America to foreign countries. It should also be noted that in accordance to the provisions in this section under the FD&C Act, foods intended for export shall not be adultered or misbranded if it:
(a) accords to the specifications of the foreign purchaser,
(b) is not in conflict with the laws of the country to which it is intended for export,
(c) is labeled on the outside of the shipping package that it is intended fpr export, and
(d) is not sold or offered for sale in domestic commerce.
Before a Certificate of Free Sale can receive the State Apostille, If the certificate is issued by the local Chamber of Commerce it must be signed and notarized. Once notarized, the document can then be mailed to us for processing. A Certificate of Free Sale can only be Apostilled in the State the document was signed and notarized in.
Once the original English Certificate of Free Sale is properly prepared you can mail it to us to be Apostilled. We can also provide Certified Translation Services into the language required by the Country of Designation.
