Power of Attorney
For those needing to handle business or family affairs on behalf of someone else in a foreign country an Apostille of a Power of Attorney is required. We recommend that an attorney or certified specialist in the designated foreign country prepare and process the Power of Attorney document in both English and the national language of that country. Some U.S. States will not Apostille a document written in a foreign language. In order to avoid this we recommend your documents be written in both languages.
After the document has been created, it should be presented to a U.S. Notary Public for Certification. The Notary must follow the proper notarization laws and procedures of their state to ensure that the document will be Apostilled. The Notary must attach the correct Notary Certification to the document. The Notary Certificate must be in English. Some States require that an English Certified Translation of the documents before a Notary can notarize them. It is best to find an experienced Notary Public to process documents proeprly in order to avoid unnecessary delays.
The Power of Attorney must be the original notarized documents. If you are unable to send in the original, you can Copy Certify the copy of the Power of Attorney and mail it to our office for Apostille Processing.
A Power of Attorney can only be Apostilled in the State where the documents were notarized in. The Secretary of State (or Lieutenant Governor) does not have the authority to Apostille documents that have been notarized in other states. Some states such as Hawaii, Kentucky, Maryland, New York, and Tennessee also require a notarized document to be Certified by the County Clerk before it can be Apostilled. If you are not in the United States but need to sign in front of a U.S. Notary Public, go to the U.S. Embassy in the country you are in and have the U.S. Consulate notarize your document. Then send the original document to us to be Apostilled.
In order for us to process your Power of Attorney, you must mail in the original notarized copy to our office. All documents received at our office must be signed and notarized. Once we receive your documents, in order to minimize errors and processing time, we verify all documents received from notaries before submitting them to be Apostilled. We will contact you as soon as possible if any errors are encountered and we will instruct you on how they need to be corrected.
Obtaining an Apostille can be a complicated process and should not be left to someone who does not understand all of the steps involved. Untrained persons that do not understand all of the requirements for legalization in each country are more likely to make errors, which will severely delay the Apostille process and cost you more money.
Once the original English Power of Attorney is properly prepared you can mail it to us to be Apostilled. We can also provide Certified Translation Services into the language required by the Country of Designation.
